4. Datenerfassung auf dieser Website
Cookies
Unsere Internetseiten verwenden so genannte „Cookies“.
- YouTube: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland. Datenschutzerklärung
- Vimeo: Vimeo.com, Inc., 330 West 34th Street, 10th Floor, New York, New York 10001, USA. Datenschutzerklärung
- Mixcloud: Mixcloud Limited, Unit #2255, 275 New North Road, London, N1 7AA, Großbritannien. Datenschutzerklärung
- SoundCloud: SoundCloud Global Limited & Co. KG, Rheinsberger Str. 76/77, 10115 Berlin. Datenschutzerklärung
- hearthis.at: Datenschutzerklärung
Merchandise-Shop (Spreadshirt)

IF YOUR PERSONAL DATA IS BEING PROCESSED IN ORDER TO ENGAGE IN DIRECT ADVERTISING, YOU HAVE THE RIGHT TO AT ANY TIME OBJECT TO THE PROCESSING OF YOUR AFFECTED PERSONAL DATA FOR THE PURPOSES OF SUCH ADVERTISING. THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS AFFILIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT ADVERTISING PURPOSES (OBJECTION PURSUANT TO ART. 21 SECT. 2 GDPR).
Right to log a complaint with the competent supervisory agency
In the event of violations of the GDPR, data subjects are entitled to log a complaint with a supervisory agency, in particular in the member state where they usually maintain their domicile, place of work or at the place where the alleged violation occurred. The right to log a complaint is in effect regardless of any other administrative or court proceedings available as legal recourses.
Right to data portability
You have the right to demand that we hand over any data we automatically process on the basis of your consent or in order to fulfil a contract be handed over to you or a third party in a commonly used, machine readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.
SSL and/or TLS encryption
For security reasons and to protect the transmission of confidential content, such as purchase orders or inquiries you submit to us as the website operator, this website uses either an SSL or a TLS encryption programme. You can recognise an encrypted connection by checking whether the address line of the browser switches from “http://” to “https://” and also by the appearance of the lock icon in the browser line.
If the SSL or TLS encryption is activated, data you transmit to us cannot be read by third parties.
Encrypted payment transactions on this website
If you are under an obligation to share your payment information (e.g. account number if you give us the authority to debit your bank account) with us after you have entered into a fee-based contract with us, this information is required to process payments.
Payment transactions using common modes of paying (Visa/MasterCard, debit to your bank account) are processed exclusively via encrypted SSL or TLS connections. You can recognise an encrypted connection by checking whether the address line of the browser switches from “http://” to “https://” and also by the appearance of the lock icon in the browser line.
If the communication with us is encrypted, third parties will not be able to read the payment information you share with us.
Information about, rectification and eradication of data
Within the scope of the applicable statutory provisions, you have the right to at any time demand information about your archived personal data, their source and recipients as well as the purpose of the processing of your data. You may also have a right to have your data rectified or eradicated. If you have questions about this subject matter or any other questions about personal data, please do not hesitate to contact us at any time at the address provided in section “Information Required by Law.”
Right to demand processing restrictions
You have the right to demand the imposition of restrictions as far as the processing of your personal data is concerned. To do so, you may contact us at any time at the address provided in section “Information Required by Law.” The right to demand restriction of processing applies in the following cases:
- In the event that you should dispute the correctness of your data archived by us, we will usually need some time to verify this claim. During the time that this investigation is ongoing, you have the right to demand that we restrict the processing of your personal data.
- If the processing of your personal data was/is conducted in an unlawful manner, you have the option to demand the restriction of the processing of your data in lieu of demanding the eradication of this data.
- If we do not need your personal data any longer and you need it to exercise, defend or claim legal entitlements, you have the right to demand the restriction of the processing of your personal data instead of its eradication.
- If you have raised an objection pursuant to Art. 21 Sect. 1 GDPR, your rights and our rights will have to be weighed against each other. As long as it has not been determined whose interests prevail, you have the right to demand a restriction of the processing of your personal data.
If you have restricted the processing of your personal data, these data – with the exception of their archiving – may be processed only subject to your consent or to claim, exercise or defend legal entitlements or to protect the rights of other natural persons or legal entities or for important public interest reasons cited by the European Union or a member state of the EU.
Rejection of unsolicited e-mails
We herewith object to the use of contact information published in conjunction with the mandatory information to be provided in section “Information Required by Law” to send us promotional and information material that we have not expressly requested. The operators of this website and its pages reserve the express right to take legal action in the event of the unsolicited sending of promotional information, for instance via SPAM messages.
4. Recording of data on this website
Cookies
Our websites and pages use what the industry refers to as “cookies.” Cookies are small text files that do not cause any damage to your device. They are either stored temporarily for the duration of a session (session cookies) or they are permanently archived on your device (permanent cookies). Session cookies are automatically deleted once you terminate your visit. Permanent cookies remain archived on your device until you actively delete them or they are automatically eradicated by your web browser.
In some cases it is possible that third party cookies are stored on your device once you enter our site (third party cookies). These cookies enable you or us to take advantage of certain services offered by the third party (e.g. cookies for the processing of payment services).
Cookies have a variety of functions. Many cookies are technically essential since certain website functions would not work in the absence of the cookies (e.g. the shopping cart function or the display of videos). The purpose of other cookies may be the analysis of user patterns or the display of promotional messages.
Cookies that are required for the performance of the electronic communications transaction or to provide certain functions you want to use (e.g. the shopping cart function), are stored on the basis of Art. 6 Sect. 1 lit. f GDPR. The website operator has a legitimate interest in storing cookies to ensure the technically error free and optimised provision of the operator’s services. If a corresponding agreement has been requested (e.g. an agreement to the storage of cookies), the processing takes place exclusively on the basis of Art. 6 para. 1 lit. a GDPR; the agreement can be revoked at any time.
You have the option to set up your browser in such a manner that you will be notified any time cookies are placed and to permit the acceptance of cookies only in specific cases. You may also exclude the acceptance of cookies in certain cases or in general or activate the delete function for the automatic eradication of cookies when the browser closes. If cookies are deactivated, the functions of this website may be limited.
In the event that third party cookies are used or if cookies are used for analytical purposes, we will separately notify you in conjunction with this Data Protection Policy and, if applicable, ask for your consent.
When you visit this website without logging in, it does not set any cookies and does not store anything in your browser. Cookies are only set when editors log in to the administration area. In that case, WordPress and the security plug-in Wordfence set cookies that are technically required for the login and for securing access. If you enable the map of gig locations, your browser remembers this in session storage (sessionStorage, entry “mg_osm_ok”). The entry is deleted when you close the browser tab. For details, please see the section “Map of gig locations (OpenStreetMap)”.
This storage is strictly necessary to provide the function you have requested. No consent is required for it (§ 25 (2) no. 2 TDDDG). This website therefore does not ask for cookie consent. External providers whose content you load by clicking may set their own cookies. For details, please see the section “Embedded content with two-click solution”.
Server log files
The provider of this website and its pages automatically collects and stores information in so-called server log files, which your browser communicates to us automatically. The information comprises:
- The type and version of browser used
- The used operating system
- Referrer URL
- The hostname of the accessing computer
- The time of the server inquiry
- The IP address
This data is not merged with other data sources.
This data is recorded on the basis of Art. 6 Sect. 1 lit. f GDPR. The operator of the website has a legitimate interest in the technically error free depiction and the optimization of the operator’s website. In order to achieve this, server log files must be recorded.
Contact form and booking request
If you write to us using the contact form or the booking request form, we store the information you enter (for example name, e-mail address, subject, message, and for booking requests also venue, address and date) in order to handle your request and any follow-up questions. The forms run on the WordPress plugin Gravity Forms. Your entries are stored in the database of this website together with the time of the request and your IP address, and are forwarded to us by e-mail. We do not share this information without your consent, apart from the spam check (see “Spam protection with Akismet”).
The processing of these data is based on Art. 6 Sect. 1 lit. b GDPR if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the requests addressed to us (Art. 6 Sect. 1 lit. f GDPR) or on your consent (Art. 6 Sect. 1 lit. a GDPR), which you give by ticking the box in the form.
To protect against automatically submitted forms, the forms contain a field that is invisible to humans (a so-called honeypot). If it is filled in, the request is discarded. No data are transferred to third parties for this purpose and no information is stored in your browser.
The data you enter in the form remain with us until you ask us to delete them, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory statutory provisions, in particular retention periods, remain unaffected.
Request by e-mail, telephone or fax
If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass these data on without your consent.
The processing of these data is based on Art. 6 para. 1 lit. b GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent (Article 6 (1) a GDPR) and/or on our legitimate interests (Article 6 (1) (f) GDPR), since we have a legitimate interest in the effective processing of requests addressed to us.
The data sent by you to us via contact requests remain with us until you request us to delete, revoke your consent to the storage or the purpose for the data storage lapses (e.g. after completion of your request). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
Spam protection with Akismet
Before they are stored, submissions from our forms are checked for spam using the Akismet service. The provider is Automattic Inc., USA. For users in the EU, the responsible entity is Aut O’Mattic A8C Ireland Ltd., Grand Canal Dock, 25 Herbert Pl, Dublin, D02 AY86, Ireland.
For the check, typically your IP address, browser identifier (user agent), the previously visited page (referrer) and the address of this website, as well as the information you entered in the form (name, e-mail address, message), are transferred to Automattic’s servers. This may involve a transfer to the USA. For this purpose, a script from Akismet is loaded on pages with forms; it is delivered from our own server.
This is based on Art. 6 Sect. 1 lit. f GDPR. We have a legitimate interest in protecting our forms against mass spam. For more information, please see https://akismet.com/privacy/ and the Automattic privacy policy: https://automattic.com/privacy/.
Protection against attacks with Wordfence
This website uses the security plugin Wordfence. The provider is Defiant, Inc., USA. Wordfence checks every request to the website (firewall) and blocks requests that indicate an attack. For this purpose, the IP address, the requested address and the browser identifier are processed. The IP addresses of blocked requests and failed login attempts are stored on our server.
The “Wordfence Security Network” feature is enabled. Information about attacks, including the IP address the attack comes from, is transferred to Defiant in the USA so that these addresses can be blocked on other websites as well. Recording of all visits (Live Traffic) is switched off.
This is based on Art. 6 Sect. 1 lit. f GDPR. We have a legitimate interest in protecting the website and the data stored on it against attacks. For more information, please see the Wordfence privacy policy: https://www.wordfence.com/privacy-policy/.
Log of pages not found and redirects
This website has been rebuilt. To keep old links working, we redirect old addresses to the new pages using the WordPress plugin Redirection. The plugin logs redirects and requests for pages that do not exist. It stores the requested address, the time, the previously visited page (referrer) and the browser identifier (user agent). Your IP address is not stored. The entries are deleted automatically after 30 days. The data are not transferred to third parties.
This is based on Art. 6 Sect. 1 lit. f GDPR. We have a legitimate interest in detecting and fixing broken links.
Comment function
The comment function of this website is switched off. Comments from previous years are no longer displayed. Together with the information collected at the time (name, e-mail address, where applicable IP address and time), they are still stored in the database of this website. If you would like your comments to be deleted, an informal e-mail to us is sufficient.
5. Social media
Links to social networks and music platforms
On this website we link to our profiles on social networks and music platforms, for example Facebook, Instagram, TikTok, SoundCloud, Mixcloud, Bandcamp, Beatport and Spotify. These are simple links. When you visit our website, no data are transferred to these providers and no plugins of these providers are loaded. Only when you click a link will you be taken to the provider’s website, where its privacy policy applies.
Some posts from our Facebook page and our Instagram account are republished as posts on our blog. For this purpose, our server retrieves the content from Meta and stores texts and images on our server. When you read these posts, there is no connection between your browser and Facebook or Instagram.
6. Plug-ins and Tools
Embedded content with two-click solution
In posts and on some pages we embed videos, music players and other content from external providers. This content is not loaded automatically. Instead, you first see a placeholder with the name of the provider and a button. Only when you click this button does your browser connect to the provider’s servers and load the content. The provider then receives at least your IP address, information about your browser and the information which of our pages you visited. The provider may also use cookies or similar technologies on your device. If you are logged in to the provider, it can assign the visit to your user account. Your decision is not stored. Each item has to be loaded individually by clicking.
Depending on the post, this applies in particular to the following providers:
- YouTube: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Privacy policy
- Vimeo: Vimeo.com, Inc., 330 West 34th Street, 10th Floor, New York, New York 10001, USA. Privacy policy
- Mixcloud: Mixcloud Limited, Unit #2255, 275 New North Road, London, N1 7AA, United Kingdom. Privacy policy
- SoundCloud: SoundCloud Global Limited & Co. KG, Rheinsberger Str. 76/77, 10115 Berlin, Germany. Privacy policy
- hearthis.at: Privacy policy
- Beatport: Privacy policy
- Bandcamp: Privacy policy
- Spotify: Privacy policy
- occasionally also Traxsource, ReverbNation, ARD Mediathek and Giphy
Some of these providers may transfer data to countries outside the EU, in particular to the USA or the United Kingdom.
The legal basis is the consent you give by clicking the button (Art. 6 Sect. 1 lit. a GDPR and § 25 (1) TDDDG). The consent applies only to the individual item. You can revoke it for the future by reloading the page.
SoundCloud player on the home page
On the home page we present current DJ sets and tracks from SoundCloud. Our server retrieves title, description and cover from SoundCloud in advance (via the public oEmbed interface and the public profile page) and caches them. The cover is stored as a copy on our server. When you open the home page, there is therefore no connection between your browser and SoundCloud.
Only when you click play does your browser load the SoundCloud player (w.soundcloud.com). From that moment, SoundCloud receives your IP address, information about your browser and the information that you visited our website. SoundCloud may set cookies and, if you are logged in to SoundCloud, assign the request to your user account. The provider is SoundCloud Global Limited & Co. KG, Rheinsberger Str. 76/77, 10115 Berlin, Germany.
The legal basis is the consent you give by clicking play (Art. 6 Sect. 1 lit. a GDPR and § 25 (1) TDDDG). For more information, please see the SoundCloud privacy policy: https://soundcloud.com/pages/privacy.
Map of gig locations (OpenStreetMap)
On the “Gigs” page we show a map of the places where Mijk van Dijk has played. The map software Leaflet is delivered from our own server. The map images (tiles) come from OpenStreetMap. The provider is the OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom.
The map is only loaded after you enable it with a click. Before that, there is no connection to OpenStreetMap. After the click, your browser loads the map images from tile.openstreetmap.org. The OpenStreetMap Foundation then receives your IP address, information about your browser and the address of the referring website. The map images are delivered through a global network of cache servers. Which server responds depends on the network at the time of the request.
So that you do not have to enable the map again on every page, your browser remembers your choice in session storage (sessionStorage, entry “mg_osm_ok”). The entry is deleted when you close the browser tab and is not transferred to us.
The legal basis is the consent you give by clicking (Art. 6 Sect. 1 lit. a GDPR and § 25 (1) TDDDG). For more information, please see the privacy policy of the OpenStreetMap Foundation: https://osmfoundation.org/wiki/Privacy_Policy.
Merchandise shop (Spreadshirt)
On the “Shop” page, the Spreadshirt merchandise shop can be loaded. The provider is sprd.net AG, Gießerstraße 27, 04229 Leipzig, Germany. The shop is only loaded when you click the button. Before that, there is no connection to Spreadshirt. After the click, your browser loads program code and content from Spreadshirt. Spreadshirt then receives your IP address, information about your browser and the information that you visited our website. Spreadshirt may use cookies or similar technologies.
Orders in the shop are processed by Spreadshirt. The Spreadshirt privacy policy applies: https://www.spreadshirt.de/datenschutz.
The legal basis for loading the shop is the consent you give by clicking (Art. 6 Sect. 1 lit. a GDPR and § 25 (1) TDDDG).
Fonts
The fonts of this website are loaded from our own server. There is no connection to Google Fonts or other font providers.
